2.1.- COMMUNICATION OF DATA AND INFORMATION FOR THE DEVELOPMENT OF THE SERVICE
To browse the store, and buy is not necessary to be registered, but the user must communicate to ATHLETIC CLUB all data necessary for the provision of services of this website and for the purposes stated in the Legal Notice and Privacy Policy of this website. The data and information provided must always be valid and updated, and it is essential that you provide all the information that we classify as mandatory because, if you do not do so, we will not be able to provide the services. We will not be responsible in any case for possible delays or failures in delivery because of error or omission of these data.
2.2.- SUBSCRIPTION PROCEDURE
The characteristics of the gorritazuria card and the advantages and discounts offered to Club Athletic members can be consulted on this website. Once you have decided to become a Club member, click on the button of your choice (whether it is for yourself or to give to someone else).
You will get a screen with a form with the necessary data. On the right side you will see information about the subscription, price, and shipping, as well as how to contact us if you need help.
The contracting is subject to Spanish law; therefore, the contracts will be understood to be made at the domicile of ATHLETIC CLUB, Alameda de Mazarredo 23, 48009 Bilbao.
The placement of the order entails in any case the obligation to pay for it. It must be paid in advance in full by credit card payment.
From this confirmation, the order is firm and will be automatically registered and ATHLETIC CLUB will proceed to its shipment and/or delivery to the address indicated. The automatic registration of the order placed has the value of proof as to its nature, content, and date. The confirmation of the order by the customer implies acceptance of prices, product description, and other conditions that are collected, in the data collection forms that the user will have to fill out, and in this document.
After the confirmation of an online order, an e-mail will be sent to the e-mail address indicated by you, confirming the registration to Club Athletic as well as the credentials to identify yourself in the private area. These credentials uniquely identify you and allow you to modify/update your personal data whenever you wish.
2.3. PRICE, CURRENCY, AND TAXES.
The applicable prices are those indicated on the website on the date the order is placed. Prices are exempt from VAT, since the entire amount is donated to the Athletic Foundation. As a result of this donation, in the month of January you will be sent by email the form 132 of the Provincial Council of Bizkaia (on donations) so that you can deduct the amount of income tax.
ATHLETIC CLUB assumes no responsibility for any possible typographical or arithmetical error that may appear in the prices indicated in its pages, but undertakes to correct it as soon as possible, to notify the error and the new amount to the people who have become members and to offer them, in the event that they do not accept the new price, the right to cancel as long as the delivery of the membership card has not yet taken place. In case of partial or total cancellation of the order for this reason, ATHLETIC CLUB undertakes to fully reimburse the amount paid within a maximum period of 14 calendar days and always by the same method used for payment.
The offers will be indicated in the product sheet and, if not otherwise indicated, will be valid once added to the shopping cart.
The products that could be shown with price 0,00 € will be canceled from the possible order placed because they are computer errors, and it is not their real price. In these cases, we promise to correct these errors as soon as possible.
The discount coupons will have a validity and special conditions for its use. Consult the specifications of each coupon before using it.
2.4. FORMS AND CONDITIONS OF PAYMENT
Only payment by Credit Card is accepted: We accept Visa, Mastercard and American Express credit cards. All online payment transactions by credit card are made through the secure payment gateway REDSYS of Kutxabank. When confirming your order, the buyer will provide the number of your bank payment card, followed by the type of card in question (among those accepted), its expiration date and the three-digit cryptogram on the back of the card.
REDSYS uses the HTTPS (SSL) protocol to establish a secure communication channel between the server and the user for sending personal data, making it impossible for third parties to access the information sent. The charge will be carried out in real time through this payment gateway. In case the charge cannot be finally carried out (for any reason), the order will be automatically cancelled. Credit cards will be subject to checks and authorizations by the credit card issuer, but if the credit card issuer does not authorize the payment, we will not be able to formalize any contract with you. Attention: Credit card fraud is a crime, and ATHLETIC CLUB will take appropriate legal action against anyone who makes a fraudulent transaction on our website.
2.5. HIPPING/DELIVERY.
ATHLETIC CLUB delivers the membership card within the Iberian Peninsula with shipping costs included in the price that appears on the screen next to each product. For deliveries in the Balearic Islands, Canary Islands, as well as abroad, an additional cost will be applied for shipping costs, which will be added to the cost of the product by including the shipping address. This shipping cost will be displayed next to the price in the order summary.
In case of force majeure (situation that prevents the delivery of the order for reasons beyond the control of ATHLETIC CLUB: strikes, war, flood or other natural catastrophe, lack or impossibility of supplying materials …) the customer will be informed with the proposal of a new delivery date without any liability for ATHLETIC CLUB.
The transport conditions contracted are for deliveries during the day, from Monday to Friday, without prior notice or the possibility of agreeing delivery at a specific time, and with two delivery attempts. If the recipient is not at home when the first attempt is made, the carrier will contact the customer by the means provided by the customer (phone call, email and/or sms) to arrange a 2nd final delivery, which will be free of charge for the customer. If this 2nd definitive delivery is not made for any reason, the package must be picked up at the branch of the transport company indicated by the carrier or at the point of convenience (parcelshop) if this option is available. The time during which the order may be picked up at the delegation indicated by the carrier, in case of not having been possible delivery at the address indicated, will depend on each agency, ATHLETIC CLUB does not exercise any control over the storage periods of undelivered shipments in transport agencies and, consequently, cannot assume any responsibility if the shipment has not been collected in that time and is finally returned to origin; in which case, ATHLETIC CLUB may charge the corresponding return costs to the customer, as well as the re-shipment costs if he/she wishes the order to be resent.
To avoid incidents in the delivery and that it can be managed correctly, it is essential to fill in the corresponding form correctly, being obligatory to fill in the box related to the contact telephone and e-mail.
Shipping and delivery time: Delivery will be made in 2-5 working days for shipments in the Iberian Peninsula. This period is estimated and not guaranteed, except for the maximum of 30 calendar days established by law and may present slight deviations due to incidents in transport for many reasons: unforeseen local holidays or exceptional periods such as Christmas or situations of high demand such as the launch of exceptional promotions or other reasons. We will keep the buyer informed of any exceptional delays. In the event that ATHLETIC CLUB does not comply with its obligation to deliver within that period, the consumer must give notice in a reliable manner to comply within an additional period appropriate to the circumstances. If ATHLETIC CLUB does not deliver the product within such additional period, the consumer shall be entitled to terminate the contract.
Products will not be delivered to post office boxes or any address that is not correctly specified.
When the goods arrive at the transport agency (SEUR) it will send an email to the buyer informing the date of delivery of the goods.
Once the purchased product has been delivered, it will become your property, and therefore, all damages, loss, etc. that may arise, will be your responsibility.
2.6. CLAIMS AND REFUNDS
Claims: Please keep the contracting CONFIRMATION EMAIL, its presentation is necessary for any claim. We will respond to the claims received as soon as possible and in any case within a maximum period of one month from the submission of the claim. ATHLETIC CLUB will be exclusively responsible in cases of non-compliance with the provision of the service, time and manner stipulated in this contract; it will not be liable in any other case for any other type of damage, of any nature or kind, which may arise from failures or delays due to force majeure, or which are beyond its control.
If for any reason you are not satisfied with your order, you have a period of 14 calendar days, counting from the date of delivery of the order, to return it or cancel your purchase.
How to return the product:
1.- Return the product in person at the office of Fundación Athletic C/Alameda de Mazarredo nº 23 (Palacio Ibaigane) CP 48009 Bilbao Bizkaia presenting the order confirmation email.
2.- Return the product by mail to the same address; being the cost of return to your account unless the product has a defect.
In the event that the product has a defect or is incorrect, it must be credited at the time of requesting its return through the following email [email protected] .
The product must be returned in perfect condition, unused and in its original packaging. It is very important that you return the product(s) correctly packaged. If the products are damaged due to improper packaging, we will not accept the return. There will be no right of withdrawal or return when there is evidence that the products have been tampered with or exposed to improper conditions.
Once we receive the goods and check that all the above conditions are met, ATHLETIC CLUB will accept the return of the product and will proceed to refund the amount on the same credit card.
Note: You will receive the refund of the amount within a maximum period of 14 days from the receipt by us of the return. Please note that if you paid by credit card, it is likely that your bank will not show the refund amount in your balance until the following month.
We do not accept freight collect returns or claims for payment of invoices for organized shipments by the customer.
Withdrawal: Once the preparation of the order has begun and it is ready for shipment, dispatch or delivery, any request for cancellation will be treated as a right of withdrawal.
To exercise the right of withdrawal, the consumer must communicate his decision in a clear way, free of any ambiguity: by email to [email protected] by sending the completed and signed withdrawal form, which can be obtained below within a maximum period of fourteen (14) calendar days from the delivery of the shipment. Once the period of fourteen (14) calendar days has expired, we will not accept returns for withdrawal of product purchases.
There will be no right of withdrawal when there are indications that the products have been tampered with or exposed to inappropriate conditions. It is mandatory to return the products properly protected, in their original packaging and in perfect condition. The return of the order in case of withdrawal will also result in the reimbursement of the entire order, including shipping costs.

2.8. JURISDICTION AND COMPETENCE
If the User is NOT a consumer, in case of conflict or dispute regarding the interpretation of these conditions, or any other matter related to the services of this Website, the applicable Jurisdiction and Regulations shall be Spanish, and the competent courts (expressly waiving any other jurisdiction that may apply) shall be those of Bilbao. If the User is a consumer, the competent courts shall be those of his domicile or those of the place of fulfillment of the obligation.
2.9. LEGAL WARRANTY
If you contract as a consumer and user, you are entitled to corrective measures, free of charge, in case of lack of conformity of the goods. We offer warranties on the products we sell through this website, in the terms legally established for each type of product, responding, therefore, for the lack of conformity of the same that is manifested within three years from the delivery of the product.
It is understood that the products are in conformity with the contract provided that (i) they conform to the description made by us and possess the qualities that we have presented on this website, (ii) they are suitable for the uses to which products of the same type are normally intended and (iii) they present the usual quality and performance of a product of the same type that are reasonably expected. In this sense, if any of the products do not conform to the contract, you must notify us following the procedure detailed in the previous section and through any of the means of communication provided for this purpose.
Defects or flaws due to incorrect use or handling of the product or wear and tear caused by normal use of the product are not included in this warranty. The decreases in the functionality of the products, due to the limitations of their conception, are also excluded from the coverage of this warranty.
If upon receipt of the order, before the product is used, you find any defect or fault in what you received, you will have to contact us through the mail [email protected]. We will ask you for a photo OR VIDEO of the defect and we will take care of collecting the product, once we receive it, we will proceed to the exchange or replacement in the ways indicated above or, in the case of not being possible, the refund of the money.
